A certificate of occupancy is a legal document issued by the local Building Department indicating the building or structure complies with the USBC, is safe to occupy and meets all local, state and-or federal regulations.
Per section 116.1 of the Virginia USBC, Prior to the occupancy (or use) or change of occupancy of a building or structure, a certificate of occupancy shall be obtained.
Pre-USBC Buildings
The owner/agent/etc. of a building or structure constructed prior to the first edition of the Virginia USBC (1973) that does not currently have a certificate of occupancy, may apply to have a certificate of occupancy issued (per 116.4 of the USBC).
Prior to the final inspection and the certificate of occupancy being issued, a number of steps are required. In order to assist in the process, we have created a PDF that lists the steps involved and has a number of documents that need to be completed.
Depending on the work involved and the scope of work of the project, a Record of Final Inspection may be issued in-leu of a certificate of occupancy.
Note: commercial buildings have additional/different requirements; including but not limited to special inspections and the Final Report of Special Inspections. Please consult with the Building & Zoning Department regarding commercial buildings.
