Tips on Testifying

  • DRESS APPROPRIATELY. The way you present yourself is a reflection on you. Leave your phone at home or in your car unless you have made arrangements before court with the prosecutor/victim witness advocate for it to be used as evidence. Come to court sober. No gum/food/drink allowed in the courtroom. Visit the courtroom ahead of time if helpful. 
  • TELL THE TRUTH, BE COURTEOUS & KEEP CALM. If called to testify, listen carefully to the questions asked. Make sure you understand each question and give an accurate answer to the best of your ability. If you need a question repeated, ask! If you do not know the answer, be sure to say so. If an attorney objects, stop talking immediately and wait for the judge's instructions. Do not argue with the attorneys or allow yourself to become upset during questioning. 
  • SPEAK LOUDLY AND CLEARLY. In order for everyone to hear your answers, you have to speak so that you can be heard. If a court reporter is present, they need to be able to transcribe your answers.
  • BE PREPARED TO WAIT. The court process can be long and frustrating. However, your role is a very important one. Your cooperation and patience are necessary. 
  • Threatening a victim or a witness is a crime in Virginia. If the defendant or anyone else threatens you in regard to your testimony, immediately call your local Sheriff's office or the Commonwealth's Attorney and notify your Victim/Witness program at (540) 948-7550.
